Scott Paler is a partner at DeWitt Ross and Stevens S.C., one of Wisconsin’s largest law firms. He serves as Chair of the Firm’s Background Screening Practice Group.
Scott has extensive experience advising companies on employment issues such as hiring processes, wage and hour practices, non-compete agreements, disciplinary investigations, and terminations. He has also helped defend companies in a wide variety of employment lawsuits, and litigated general commercial disputes.
Uniquely, Scott has developed a niche expertise in background screening. Over the last twelve years, he has assisted employers nationwide in creating and administering sound, legally compliant background screening programs. Among other things, he has helped employers prepare consent forms and adverse action letters, determine when they can reject a candidate based upon background screening information, and respond to lawsuits related to background screening practices.
In addition to representing employers, Scott has advised dozens of background screening providers throughout the country. He has worked closely with them to develop strong end-user and vendor contracts, determine whether information can be reported under the Fair Credit Reporting Act and state laws, and handle lawsuits and legal complaints. Scott served as Co-Chair of the Litigation Avoidance Committee for the National Association of Professional Background Screeners (NAPBS) for several years, led NAPBS’ Insurance Task Force, and also acted as a member of NAPBS’ Ethics Committee.
