Creditor’s Remedies

  • Through a reverse-piercing of the corporate veil in a contested action, our attorneys established the validity and priority of a marital lien encumbering commercial property – in a total amount exceeding $719,000.
  • In a recent $6 million construction loan, we were brought in to correct substantial defects in an attempted foreclosure.  DeWitt repaired the defects, uncovered borrower fraud, and recovered equipment wrongfully removed.

Insurance Coverage Litigation

  • Our attorneys represented a paper company against multiple insurers who had denied coverage for hundreds of millions of dollars in exposure from environmental contamination.  The case was tried to a jury for five weeks in Brown County Circuit Court and the company won against all of its insurers on all of their policies.  The decision was affirmed by the Wisconsin Court of Appeals.
  • DeWitt collected millions of dollars for a Wisconsin city after its insurers had denied coverage for the costs of re-mediating former city landfills.
  • We successfully defended an insurance company in a $1.7 million coverage action.

Lien Priority Disputes

  • In an approximately $18 million office and residential condominium project, our attorneys recently defended a purchase money lender in an action brought by another purchase money lender. Our insistence on questioning shared assumptions revealed the earlier delivery of the mortgage to DeWitt’s client, which ultimately led to the resolution of the action. 
  • Our litigation practice regularly involves contested priority disputes between lenders, or between lenders and other secured lien creditors, including holders of judgment liens, tax liens, martial liens, attorney’s liens and mortgages. We frequently deal with actual and constructive notice cases, equitable subrogation cases, equitable liens, lien circuity, and marshaling.

Mechanic’s Liens

  • Our Title Insurance Group has extensive involvement in large multi-party mechanic’s lien cases.  We have avoided or defeated millions of dollars worth of mechanic’s lien claims.
  • We recently defended a multi-million dollar mechanic’s lien foreclosure action by a general contractor and most of its subcontractors against commercial property significantly reducing and eliminating those mechanic’s liens for our insured lender.  In a similar action, we represented one of our title insurance underwriters, we successfully avoided coverage for several million dollars of lien claims by advancing a rarely used and novel title insurance coverage defense focusing on the definition of lender loss. 
  • DeWitt led the mechanic’s lien defense against the general contractor in one of the largest mechanic’s lien cases in recent Minnesota history.  In a $70 million hotel and condominium project in downtown Minneapolis, our attorneys formulated and argued a successful apportionment defense—splitting liens up among various portions of the project, and then splitting them further among unsold condominium units.
